Minister gives licensing warning
| A HOME OFFICE Minister has admitted pubs and clubs
in Wales could be forced to close over Christmas and the New Year because
too few businesses understand the Government's new licensing laws.
James Purnell has warned a widespread failure to understand and comply
with the Licensing Act 2003 has led to severe delays in the process which
threatens to hit the industry at one of the most profitable times of the
year.
All businesses, not just those interested in longer opening hours, need
to apply for a new licence by August 6, but councils so far have received
just a trickle of applications.
Less than 7% of all licensed premises in England and Wales have applied
to date and, with forms running to 16 pages long, half of all those submitted
have been returned because of errors.

In July 2003, the Licensing Act 2003 was introduced, and this will
totally reform the Country’s licensing laws. The changes introduced by
this act will commence in February 2005 and come fully into place.

How does this affect you?
The transitional period started on the 7th February 2005 and will run until
7th August 2005, it will be possible to convert all licences that existed on
7th February into new premises licences.
- It will also be possible for individuals to convert their Justices’
Licences into personal licences during this period.
- The transitional period will last for a minimum of a further 3 months to
enable applications to be concluded. The second appointed day has been announced
as 24th November.
- An omission to convert during this period will result in the need to apply
for a new premises licence.
- Any licence or certificate declared final or granted after 7th February
cannot be converted. An application for a new premises licence must be made.
- On 24th November, all licences granted by the local authority will come
into force. Also on this day all licences and certificates granted by the
Court and all entertainment licences including other licences granted by the
councils, will automatically expire. No new licence, cease trading
